“Crabtree Home Collections” (referred to as “Crabtree Home Collections”, “we”, “us”, “our”) is the owner and publisher of the content contained in this website (“Site”). Your use of this Site is subject to these terms and conditions (“Terms”), our Privacy Policy and any other laws or regulations which apply to this Site. If you do not accept these Terms, you must refrain from using the Site.

Products and Services

Crabtree Home Collections operates the Site as an online store for the sale and purchase of retail goods.

The Site may contain information from a number of suppliers of retail products. The Site provides you with the opportunity to purchase goods or services provided by suppliers to Crabtree Home Collections for sale on the Site.

We are not an agent for the suppliers, nor are we an agent for any third party suppliers of any goods or services that are advertised on the Site.

Information contained on the Site about goods and services offered by a supplier is provided by that supplier. We do not monitor, verify or endorse information submitted by suppliers for posting on this Site and you should be aware that such information may be inaccurate, incomplete, out of date and may change at any time.

Pricing and Payment

The price of goods ordered is the current price at the time of delivery, unless a specific price has been quoted. All prices are in Australian dollars. Payment for goods online may be made by an approved business account.

All prices displayed on our website are in Australian dollars and include GST. All payments are processed in Australian dollars. We accept payment by various methods, including by credit card (Visa and MasterCard), PayPal and Afterpay.

The retail price for each product is provided to us by our supplier and is shown alongside the sale price for your reference. Prices are subject to change effective immediately upon posting to our website or other form of notification.

In some cases, our products may be sourced from international markets and may not be available for sale elsewhere in Australia. In that case our supplier provides us with a retail price in Australian dollars based upon a conversion of the price in the market from which the products were sourced. In cases where our products have not previously been sold in any retail market, we work with our supplier to set a retail price based upon the price of products we deem to be competitive products in the Australian retail market.

Payment Security

In relation to ensuring your safety when making online credit card payments, always look for ‘https://’ in the address bar as well as the padlock or key symbol in the bottom right hand corner of your browser window. Please note if you are using IE 7 Windows browser, the padlock can be found in the top right hand corner at the end of the address.

We use industry standard encryption to keep your personal information secure throughout the payment process. We do not permanently store your credit card or bank information. We will not be liable for any damages or losses (whether direct or indirect) caused if a member’s card is used fraudulently.

In an effort to prevent fraudulent use of credit cards or other payment options, we will undertake reasonable efforts to validate the legitimacy of the order and payment method. This process may include requesting proof of identity and a formal check on. However, we do not guarantee that we can prevent the fraudulent use of such information by unauthorised third parties. In instances of high value orders being placed and/or where we suspect your card may be at risk of fraudulent use, we will follow internal company procedures to confirm the order is bona fide. Orders undertaking a formal check will be placed on hold until we have received confirmation this transaction is legitimate. Where we cannot reasonably rule out fraudulent card use prior to processing your order, we may decide to cancel the order (notifying you via email).

Risk and Title

Crabtree Home Collections will retain title to the goods you order until you have made payment in full for those goods but all risk in the goods will pass to you upon the delivery of the goods to, or the collection of the goods by, a postal or courier service. You should consider whether to obtain any suitable insurance in respect of the goods.

Orders and Deliveries

You may place an order for goods via the shopping cart tool on the Site.

After you have placed your order and we have processed your payment we will provide you with an order confirmation by email. This email does not guarantee that the product(s) you have ordered is/are available. It represents confirmation that we have received your order. Your order represents an offer to purchase, which we accept when we dispatch your product(s) and send you an email confirming that your product(s) has/have been dispatched. Once this email has been sent and the goods have been handed over to the designated carrier, the contract between you and us is complete. The sale contract is therefore concluded in Australia.

If delivery of an order will result in unacceptably high freight charges to Crabtree Home Collections, we reserve the right to contact you to request further shipping fees or to cancel an order prior to dispatch. If we cancel your order in these circumstances we will issue a full refund to you.

In the unlikely event that a product is unavailable, we reserve the right to cancel your order prior to dispatch. We will contact you by email as soon as possible to let you know. You may choose to have a store credit to your account or a refund to the value of the unavailable product. We reserve the right not to accept your order if we are unable to obtain authorisation for payment, where we suspect fraudulent activity, or where you do not meet the eligibility criteria set out, or otherwise contemplated, within these Terms and Conditions or our website. We reserve the right to refuse to process or refuse service to anyone at any time at our sole discretion.

All products advertised on the Site are subject to availability and may be discontinued at any time without notice. We accept no responsibility or liability for any goods we are unable to supply for any reason.

We reserve the right to correct any errors or misprints and we have no responsibility if any of the goods or services advertised on the Site are unavailable. Back orders will be recorded and delivered when available, unless otherwise advised.

NOTE:

Crabtree Home Collections will attempt to deliver or dispatch all orders within two (2) weeks from the date the order is made, however Crabtree Home Collections accepts no responsibility for delays. If stock is ordered from overseas, there may be delay of up to six (6) weeks. We will notify you of any unexpected delays as soon as reasonably possible.

Competitions

From time to time competitions and promotions (“Competitions”) may be posted on this Site. We shall publish the relevant terms and conditions of the competitions. Please ensure you read the terms and conditions of a competition before you enter into a competition.

The purpose of our Social Media pages and our Blog is to provide Crabtree Home Collection’s fans with inspiration, information on our sale events, access to special promotions plus the latest goings on at Crabtree Home Collection and from our circle of friends. We welcome contributions on this topic.
